1. The Service
Omega Guard helps businesses verify their authentic digital identity and monitors the public web for clone and impostor sites that copy a member's brand. The public verification tool lets anyone check whether a website is a verified member, unknown, or a reported impostor. The Service assists human review; it does not provide legal advice.
2. Eligibility
The Service is intended for businesses and the customers who interact with them. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these terms.
3. Member responsibilities
- You may enroll for monitoring only domains and brands that you own or are authorized to protect.
- You agree to provide accurate enrollment information and to verify control of the domains you submit.
- You will not use the Service to harass, target, or interfere with parties other than confirmed impostors of your own brand.
4. Acceptable use
You agree not to misuse the Service, including by attempting to access systems or data you are not authorized to access, interfering with the Service's operation, scraping or overloading the public verification tool, or using the Service for any unlawful purpose.
5. Verification results
The public verification tool reports the current status of a domain in our system. An "unknown" result means a domain is not an enrolled member, not that it is safe or unsafe. Verification results are provided for information only and are not a guarantee about any website.
6. Intellectual property
The Service, including its software, content, and design, is owned by Omega Point Solutions LLC and protected by law. "Omega Guard" and "Omega Point Solutions" are trademarks of Omega Point Solutions LLC. We grant you a limited, revocable, non-exclusive license to use the Service as intended; you receive no other rights.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. Because impersonation evolves constantly, we do not warrant that the Service will detect every clone or impostor, that any particular site will be removed, or that detection will be error-free. Takedowns ultimately depend on third parties such as registrars and hosts.
8. Limitation of liability
To the fullest extent permitted by law, Omega Point Solutions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.
9. Indemnification
You agree to indemnify and hold harmless Omega Point Solutions LLC from claims arising out of your misuse of the Service or your violation of these terms or applicable law.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these terms or to protect the Service or third parties.
11. Governing law
These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Illinois.
12. Changes
We may update these terms as the Service evolves. We will revise the effective date above when we do; continued use of the Service means you accept the updated terms.
